ACT No. 14

AN ACT
To amend and reenact the initial Paragraph and Paragraph (14) of Section 477 and Section 964 of Title 13 of the Louisiana Revised Statutes of 1950; to amend Section 477 of said Title 13 by adding thereto a new Paragraph to be designated as R.S. 13:477(38); to amend said Title 13 by adding thereto new Sections to be designated as Sections 621.38 and 979; to amend and reenact Sections 302,303, 304, and 305 of Title 16 of the Louisiana Revised Statutes of 1950; to amend Chapter 2 of said Title 16 by adding thereto a new Part, to be designated as Part XXXIV thereof, consisting of Sections 891 and 892 of said Title 16; all relative to the judicial districts of the state; to submit to the voters of the existing Fourteenth Judicial District, for their approval or disapproval, a proposition to divide the Fourteenth Judicial District, composed of the parishes of Calcasieu and Cameron, by continuing the Fourteenth Judicial District composed of Calcasieu Parish and establishing the Thirty-Eighth Judicial District composed of Cameron Parish; to provide for the continuation of the offices of the judges, district attorney and assistant district attorneys of the Fourteenth Judicial District; to provide for the establishment of the offices of judge and district attorney of the Thirty-Eighth Judicial District; to provide for the election of a judge and a district attorney for the Thirty-Eighth Judicial District; to provide for the additional salaries of the district attorneys of the Fourteenth and Thirty-Eighth Judicial Districts; to provide for the additional salaries of the assistant district attorneys of the Fourteenth and Thirty-Eighth Judicial Districts; to provide with respect to court reporters; to provide for the effective date of the division of the existing Fourteenth Judicial District and the establishment of the Thirty-Eighth Judicial District; to provide for the effectiveness of the Act; and to provide with respect to matters generally and specifically related to the division of the Fourteenth Judicial District and the establishment of the Thirty-Eighth Judicial District. Be it enacted by the Legislature of Louisiana:
Section 1. The initial Paragraph and Paragraph (14) of Section 477 of Title 13 of the Louisiana Revised Statutes of 1950 are hereby amended and reenacted and Paragraph (38) of said Section 477 is hereby enacted to read as follows:
§477. Judicial districts
There shall be thirty-eight judicial districts in the state, the parish of Orleans excepted, and each district shall be composed as follows:
(14) The parish of Calcasieu shall compose the Fourteenth District.
(38) The parish of Cameron shall compose the Thirty-Eighth District.

Section 7. The governor, within fifteen days after the effective date of this Section, shall call a special election to be held at the same time as the congressional primary elections to be held in 1978 for the following purpose:
To submit to a vote of the electors of the existing Fourteenth Judicial District, being the parishes of Calcasieu and Cameron, for their approval or disapproval as provided in Section 15 of Article V of the Louisiana Constitution of 1974, the following proposition in substantially the following form:
FOR the proposition that the Fourteenth Judicial District be divided, effective March 1, 1979, by the establishment of the Thirty-Eighth Judicial District composed of Cameron Parish, and continuing the Fourteenth Judicial District composed of Calcasieu Parish as provided by Act No. 14 of the 1978 Regular Session of the Louisiana Legislature.
AGAINST the proposition that the Fourteenth Judicial District be divided, effective March 1, 1979, by the establishment of the Thirty-Eighth Judicial District composed of Cameron Parish, and continuing the Fourteenth Judicial District composed of Calcasieu Parish as provided by Act No. 14 of the 1978 Regular Session of the Louisiana Legislature.
The secretary of state shall fill in the number of this Act in the propositions.
The special election provided for in this Section shall be conducted in accordance with law.
Section 8. If the proposition submitted to the electors as is provided for in Section 7 of this Act is approved by the electors:
(1) on and after March 1, 1979, the Fourteenth and Thirty-Eighth Judicial Districts shall be composed as is provided in Section 1 of this Act;
(2) the governor, within fifteen days after the date the results of the referendum provided for in Section 7 of this Act become official as provided in Section 575 of the Louisiana Election Code, shall call a special election for the purpose of electing a judge and a district attorney for the Thirty-Eighth Judicial District; the primary election shall be held on the first Saturday in January, 1979; and the general election shall be held on the sixth Saturday after the first Saturday in January, 1979. The elections herein provided for shall be conducted in accordance with law;
