Judicial District Boundary Law in Louisiana: 1979

AN ACT
To amend and reenact the initial paragraph and Paragraph (10) of Section 477 of Title 13 of the Louisiana Revised Statutes of 1950, to amend said Section 477 by adding thereto a new Paragraph, to be designated Paragraph (39) thereof; to amend said Title 13 by adding thereto a new Section, to be designated as Section 621.39 thereof; to enact Paragraph (39) of Section 51 and amend and reenact Sections 241 through 244 all of Title 16 of the Louisiana Revised Statutes of 1950; to amend Chapter 2 of said Title 16 by adding thereto a new Part, to be designated Part XXXIX thereof and to be comprised of R.S. 16:901, all relative to the judicial districts of the state, to submit to the voters of the existing Tenth Judicial District, for their approval or disapproval, a proposition to divide the Tenth Judicial District, composed of the parishes of Natchitoches and Red River, by continuing the Tenth Judicial District composed of Natchitoches Parish and to establish the Thirty-Ninth Judicial District composed of Red River Parish; to provide for the continuation of the offices of the judges, district attorney, and assistant district attorneys of the Tenth Judicial District; to provide for the establishment of the offices of judge and district attorney of the Thirty-Ninth Judicial District and to authorize an assistant district attorney for said district; to provide for the election of a judge and a district attorney for the Thirty-Ninth Judicial District; to provide for the additional salaries of the district attorneys of the Tenth and Thirty-Ninth Judicial Districts; to provide for the additional salaries of the assistant district attorneys of the Tenth Judicial District; to provide for the effective date of the division of the existing Tenth Judicial District and the establishment of the Thirty-Ninth Judicial District; to provide for the effectiveness of the Act; to provide with respect to matters generally and specifically related to the division of the Tenth Judicial District and the establishment of the Thirty-Ninth Judicial District; and to repeal Sections 245 and 246 of Title 16 of the Louisiana Revised Statutes of 1950 which were made obsolete by the placing of the language contained in those Sections in other provisions of law. Be it enacted by the Legislature of Louisiana:
Section 1. The initial paragraph and Paragraph (10) of Section 477 of Title 13 of the Louisiana Revised Statutes of 1950 are hereby amended and reenacted, and Paragraph (39) of said Section 477 is hereby enacted, all to read as follows:
§477. Judicial districts
There shall be thirty-nine judicial districts in the state, the parish of Orleans excepted, and each district shall be composed as follows:
(10) The parish of Natchitoches shall compose the Tenth District. 
(39) The parish of Red River shall compose the Thirty-Ninth District.

Section 12. The provisions of Sections 7, 8, 9, 10, 11, 12, 13, and 14 of this Act shall become effective upon signature by the governor or, if not signed or vetoed by the governor, upon expiration of the time for bills to become law without signature by the governor, as provided by Article III, Section 18 of the Constitution. The provisions of Section 6 of this Act shall become effective on September 1, 1979, and the provisions of Sections 1, 2, 3, 4, and 5 of this Act shall become effective on March 1, 1980, if the proposition submitted to the electors as provided in Section 8 of this Act is approved by the electors. If the proposition is disapproved, the provisions of this Act shall expire and be null, void, and of no effect.
Section 13. For the purpose of transmission of this Act to the United States Department of Justice, as required by federal law, this Act shall become effective upon signature by the governor, or if not signed or vetoed by the governor, upon expiration of the time for bills to become law without signature by the governor, as provided by Article III, Section 18 of the Constitution.
Section 14. All laws or parts of laws in conflict herewith are hereby repealed, and R.S. 16:245 and R.S. 16:246 are hereby repealed in their entirety.
Section 15. If any provision or item of this Act or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this Act which can be given effect without the invalid provisions, items, or applications, and to this end the provisions of this Act are hereby declared severable.
