House Bill No. 1580. By: Mr. Simoneaux and Senator Casey and Messrs. Accardo, Alario, Charbonnet, D'Gerolamo, Dimos, Ensminger, Sour and Weaver.
AN ACT
To amend and reenact Sections 621.16, 621.22, 621.24, and 621.29 of Title 13, the initial paragraph and Paragraph (20) of Section 477 of Title 13, Paragraph (20) of Section 51 of Title 16, and Sections 431, 432, 433, and 434 of Title 16, to amend Section 477 of Title 13 by adding thereto a new Paragraph, to be designated as Paragraph (40), to amend Title 13 by adding thereto a new Section to be designated as Section 621.40, to amend Section 51 of Title 16 by adding thereto a new Paragraph, to be designated as Paragraph (40), and to amend Title 16 by adding thereto a new Part to be designated as Part XXXVI of Chapter 2 to be comprised of Sections 911, 912, 913, and 914; all Titles of the Louisiana Revised Statutes of 1950, relative to the establishment of additional offices of judges, district attorneys, assistant district attorneys, and new judicial divisions, to provide for the modification of the number of judgeships in the Sixteenth, Twenty-Second, Twenty-Fourth, and Twenty-Ninth Judicial Districts, to provide for the creation of a new judicial district out of the Twentieth Judicial District, to provide for a district attorney and assistant district attorneys for the Twentieth Judicial District and new judicial district; to provide for a judgeship for the new judicial district, and otherwise to provide with respect thereto.
Be it enacted by the Legislature of Louisiana:

§477. Judicial districts
There shall be forty judicial districts in the state, the parish of Orleans excepted, and each district shall be composed as follows:
(20) The parish of East Feliciana shall compose the Twentieth District.
(40) The parish of West Feliciana shall compose the Fortieth District.

(g). The governor, within fifteen days after the effective date of this Subsection, shall call a special election, to be held on the third Saturday in October of 1981 as provided in R.S. 18:402(F)(4), to submit to a vote of the electors of the existing Twentieth Judicial District, being the parishes of East Feliciana and West Feliciana, for their approval or disapproval as provided in Section 15 of Article V of the Louisiana Constitution, the following proposition in substantially the following form:
FOR the proposition that the Twentieth Judicial District be divided, effective March 1, 1982, by the establishment of the Fortieth Judicial District composed of West Feliciana Parish, and continuing the Twentieth Judicial District composed of East Feliciana Parish as provided by Act No. - of the 1981 Regular Session of the Louisiana Legislature.
and also:
AGAINST the proposition that the Twentieth Judicial District be divided, effective March 1, 1982, by the establishment of the Fortieth Judicial District composed of West Feliciana Parish, and continuing the Twentieth Judicial District composed of East Feliciana Parish as provided by Act No. - of the 1981 Regular Session of the Louisiana Legislature.
The secretary of state shall fill in the number of this Act in the propositions.
The special election provided for in this Subsection shall be conducted in accordance with law.

Section 6. Except as otherwise specifically provided in this Act, the provisions of this Act shall become effective upon signature by the governor or, if not signed by the governor, upon expiration of the time for bills to become law without signature by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.
Section 7. If any provision or item of this Act or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this Act which can be given effect without the invalid provisions, items, or applications, and to this end the provisions of this Act are hereby declared severable.
Section 8. All laws or parts of laws in conflict herewith are hereby repealed.
