SENATE BILL NO. 232 BY SENATORS CRAVINS AND JONES
AN ACT
To amend and reenact R.S. 13:477(16) and 621.16, relative to the courts and the judiciary; to geographically divide the Sixteenth Judicial District into election sections for the purpose of qualification and election of judges; to provide for the number of judges and for the judges to be elected from election sections; to provide relative -- the terms of offices of the judges; to provide for an effective date of these provisions; and to provide for related matters.
Be it enacted by the Legislature of Louisiana:
Section 1. R.S. 13:477(16) and 621.16 are hereby amended and reenacted to read as follows:
§477. Judicial districts
There shall be forty judicial districts in the state, the parish of Orleans excepted, and each district shall be composed as follows:
(16) The parishes of St. Mary, Iberia, and St. Martin shall compose the Sixteenth District. The Sixteenth District shall consist of two election sections. Election section 1 shall consist of precincts 1-1, 1-2, 2-2, 4-1, 2-1, 2-3, 1-4, 4-2, 4-3, 4-4, 4-5, 11-6, 9-1, 9-3, 10-2, 12-1, 12-2, 12-3, 12-6, 2-5, 14-2, 11-7, 12-4, 12-8, 10-1, 3-4 of Iberia Parish; precincts 1-4, 2-1 & 2-3, 3-1, 4-1, 4-3, 6-3, 7-2, 7-3, 3-7, 1-6, 2-4, 3-8, 3-5 and 3-9 of St. Martin Parish; and precincts 2, 3, 4, 7, 9, and 14 of St. Mary Parish.
Election section 2 shall consist of precincts 1-3, 5-6, 3-1, 3-2, 3-3, 1-5, 5-1, 5-2, 5-3, 5-4, 7-6, 1-6, 6-1, 6-2, 6-3, 7-1, 7-2, 7-3, 7-4, 7-5, 8-1, 8-2, 8-3, 8-4, 8-5, 9-2, 9-4, 9-5, 6-5, 10-3, 10-4, 11-1, 11-2, 11-3, 11-4, 11-5, 3-5, 5-8, 13-4, 13-5, 13-6, 14-1, 14-3, 14-4, 13-2, 14-6, 14-5, 5-5, 2-4, 4-6, 7-7, 8-6, 5-7, 6-4, 12-5, 12-7, 13-3, and 13-1 of Iberia Parish; precincts 1-1, 1-2, 1-3, 1-5, 2-2, 3-2, 3-3, 3-6, 4-6, 3-4, 4-2, 4-4, 4-5, 5-1, 5-2, 5-3 & 5-4, 6-1, 6-2, 6-4, 7-1, 7-4, 8-1, 9-4, 9-5, 8-3, 8-4, 9-1, 9-2, 9-3, 1-7, and 8-2, of St. Martin Parish; and precincts 1, 5, 6, 8, 10, 11, 12,13,15,16,17,18,19,20, 21,22,23, 24,25,26,27, 28, 29,30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 18A, 19A, 34A, and 35A of St. Mary Parish.
§621.16. Sixteenth judicial district
The sixteenth judicial district court shall have eight judges. Two judges shall be elected from election section 1 and six judges shall be elected from election section 2.
Section 2.(A) The precincts enumerated in Section 1 of this Act are the precincts existing as of April 1, 1991, established by the governing authority of each parish in conformity with R.S. 18:532, however, if any precincts have been changed by ordinance of the respective parish governing authority under the provisions of R.S. 18:532.1(H) since April 1, 1991, and validated by the Legislature of Louisiana prior to March 1, 1992, then the precincts are those validated by the legislature.
(B) With respect to any precincts referenced in this Act that have been subdivided by action of any parish governing authority or registrar of voters on a nongeographic basis, or subdivided by action of the parish governing authority on a geographic basis under the provisions of R.S. 18:532.1(H), the reference in this Act to a precinct shall be construed to include all polling or geographic subdivisions thereof irrespective of the creation of such subdivision by a parish governing authority or registrar of voters.

HOUSE BILL NO. 1528 BY REPRESENTATIVES ACCARDO AND QUEZAIRE
AN ACT
To amend and reenact R.S. 13:477(23) and 621.23, relative to the election of certain judges; to redistrict the election sections of the Twenty-third Judicial District; to provide for the number of judges to be elected from each election section; to add an additional judgeship to the Twenty-third Judicial District; to provide for the judges to be elected from each election section; to provide relative to the terms of offices of the judges; to provide for the effectiveness of such provisions; to provide with respect to the terms of office of certain persons elected to succeed to certain court of appeal judgeships; and to provide for related matters.
Be it enacted by the Legislature of Louisiana:
Section 1. R.S. 13:477(23) and 621.23 are hereby amended and reenacted to read as follows:
§477. Judicial districts
There shall be forty judicial districts in the state, the parish of Orleans excepted, and each district shall be composed as follows:
(23) The parishes of Assumption Ascension, and St. James shall compose the Twenty-third District. The Twenty-third District shall consist of two election sections. Election section one shall consist of Precincts 15, 27A, 27B, 28, 29, 32, 33, 35A, and 35B of Ascension Parish, Precincts 1-1, 7-1, and 7-LA of Assumption Parish, and Precincts 7,7A, 11, 12 13, 14, 15, and 15A of St. James Parish. Election section two shall consist of Precincts 1, 2, 3, 4A, 4B, 5A, 5B, 5C, 6, 7A, 7B, 8A, 8B, 9, 10A, 10B, 11A, 1iB, 12, 13, 14, 16A, 16B, 21A, 21B, 22A, 22B, 23, 31, 34, 36, 37, 40, 41, and 42 of Ascension Parish, Precincts 1-2, 2-1, 2-2, 2-3, 3-1, 3-2, 4-1, 4-2, 4-3, 5-1, 5-2, 5-3, 5-4, 6-1, 6-1 A, 6-2, 6-3, 7-2, 8-1, 8-2, 9-1, and 9-2 of Assumption Parish, and Precincts 1, 2, 3, 4, 5, 5A, 6, 8, 8A, 9, 10, 16, 17, 17A, and 18 of St. James Parish.
§621.23. Twenty-third judicial district
The Twenty-third Judicial District Court shall have five judges. One judge shall be elected from election section one, and four judges shall be elected from election section two.

Section 8. The provisions of Section 7 of this Act shall become effective upon signature by the governor or, if not signed by the governor, upon expiration of the time for bills to become law without signature by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act shall become effective on the day following such approval.
Section 9. The provisions of Sections 1 through 6 of this Act shall become effective on August 1, 1993.

Section 19 of Article III of the Constitution of Louisiana of 1974 reads as follows:


"Section 19. All laws enacted during a regular session of the legislature shall take effect on August fifteenth of the calendar year in which the regular session is held and all laws enacted during an extraordinary session of the legislature shall take effect on the sixtieth day after final adjournment of the extraordinary session in which they were enacted. All laws shall be published prior thereto in the official journal of the state as provided by law. However, any bill may specify an earlier or later effective date."


The Regular Session of the Legislature of Louisiana for the year 1993, which convened on March 29, 1993, adjourned June 10, 1993.
