A Brief History of the Louisiana Juvenile Courts: 1975

Act 297: AN ACT
To amend and reenact Section 1578.1 of Title 13 of the Louisiana Revised Statutes of 1950, relative to juvenile detention facilities; to limit the children placed therein to those alleged to have committed a delinquent act; to establish further criteria for such detention; to provide the effective date of this Act to be July 1, 1976; and otherwise to provide with respect thereto.

Act 337: AN ACT
To amend and reenact Paragraph 5 of Subsection A of Section 1570 of Title 13 of the Louisiana Revised Statutes of 1950 and to amend Section 1571.1 of said Title by adding thereto a new Subsection to be designated Subsection D thereof relative to prosecution of juveniles; to provide that the district court shall retain jurisdiction over juvenile offenders who have attained the age of fifteen years and are alleged to have committed a capital offense or attempted aggravated rape; to provide for the transfer of juvenile offenders from the juvenile court to the district court without a previous adjudication of delinquency when such juvenile is alleged to have committed armed robbery or a crime punishable by life imprisonment, and to provide otherwise with respect thereto.

Act 355: AN ACT
To amend the Louisiana Code of Criminal Procedure by adding thereto a new Article, to be designated as Article 317.1 thereof, relative to bail, to authorize magistrates to make a written request of any juvenile court for all criminal records relating to a defendant before the requesting magistrate for purposes of fixing bail; to require prompt compliance with such request; to prohibit any uplication of such records; to require the prompt return thereof; to provide for violations of these provisions, and otherwise to provide with respect thereto.
 

Act 357: AN ACT
To amend and reenact Section 1586.3 of Title 13 of the Louisiana Revised Statutes of 1950, relative to the booking of arrested juveniles, to provide for the duty of arresting officers; to provide for the keeping of separate juvenile booking records, and otherwise to provide with respect thereto.

Act 379: AN ACT
To amend Title 13 of the Louisiana Revised Statutes of 1950 by adding thereto a new Section, to be designated as Section 1578.2 thereof, relative to detention of children, to provide with respect to the detention of certain neglected or dependent children, certain children in need of supervision, and certain children who absent themselves from home or their usual place of abode without consent of parent or custodian.

Act 738: AN ACT
To amend and reenact Subsection (3) of Section 1569 of Title 13 of the Louisiana Revised Statutes of 1950, relative to definition of "child" for purposes of the jurisdiction of juvenile courts.

Act 743: AN ACT
To amend Title 13 of the Louisiana Revised Statutes of 1950 by amending and reenacting Sections 102, 311, 691, 694, 695, 699, 1564, 1566, Subsection C of Section 1596, and by repealing Sections 692, 1141, 1141.1, 1142, 1341, 1341.1 and Subsection (F) of Section 1377 thereof, all relative to judges and judicial salaries; to increase the salary of the justices of the supreme court; to increase the salary of each judge of the courts of appeal; to increase the annual salary payable by the state to district and certain other judges and magistrates, and to provide with respect thereto; to provide with respect to the salary and qualifications of the judge of the juvenile court for Caddo Parish; to provide with respect to payment of expenses to district judges; and otherwise to provide with respect thereto.

Act 756: AN ACT
To amend and reenact Section 1580 of Title 13 of the Louisiana Revised Statutes of 1950, relative to decrees of the court to provide that only a child over the age of thirteen who has been adjudged a proper person for commitment based on a finding of delinquency may be confined for an indefinite period but in no case beyond his twenty-first birthday and children with a temporary excused absence or adults in this category may be recommitted until their twenty-first birthday; to provide that a neglected child or a child in need of supervision may be confined for an indefinite period but in no case beyond his eighteenth birthday and paroled children in this category may be recommitted until their eighteenth birthday.
