A Brief History of the Louisiana Juvenile Courts: 1974

Act 155: AN ACT
To amend and reenact Section 1580 of Title 13 of the Louisiana Revised Statutes of 1950, to provide that only those juveniles adjudicated delinquent may be committed to the department of corrections, and that no child under the age of thirteen shall be committed to such department unless the reason for the adjudication of delinquency was the commission of a delinquent act which would have been a felony if committed by an adult; to provide for the effective date of this Act; and otherwise to provide with respect thereto.


 Act 399: AN ACT
To amend and reenact Section 1598 of Title 13 of the Louisiana Revised Statutes to provide that any judge of the Twenty-fourth Judicial District may discharge the duties of the judge of the Juvenile Court for the Parish of Jefferson in his absence; to provide for the appointment and salary of an attorney at law to discharge the duties of such judge in his absence and to repeal all laws or parts of laws in conflict therewith.

Act 409: AN ACT
To amend and reenact Subsections B and C of Section 1566 of Title 13 of the Louisiana Revised Statutes of 1950 relative to the salary of the judges of the Orleans Parish Juvenile Court.

Act 424: AN ACT
To amend and reenact Section 1583 of Title 13 of the Louisiana Revised Statutes of 1950, relative to court ordered examinations or treatment of juveniles, to require that any court of competent jurisdiction, before committing a juvenile to any state supported facility for the mentally retarded, must order an interdisciplinary professional examination by a diagnostic and evaluative team officially appointed by the Division of Mental Retardation of the Louisiana Health and Social and Rehabilitation Services Administration, to ascertain that the juvenile's needs can be met in an available residential facility.

Act 559: AN ACT
To amend Title 13 of the Louisiana Revised Statutes of 1950 by adding thereto a new section, to be designated as R.S. 13:1578.1
thereof relative to juvenile detention facilities; to limit the children placed therein to those alleged to have committed a delinquent act; to establish further criteria for such detention; and otherwise to provide with respect thereto.

Act 560: AN ACT
To amend Section 1577 of Title 13 of the Louisiana Revised Statutes of 1950 by adding new subsections thereto, to be designated
Subsections D and E thereof, relative to detention and release of children, to provide a maximum time limit a child may be detained before being charged or released; to require that written reasons for custody be provided the parent, guardian or other person having custody or care of the child whenever the child is detained for more than twelve hours, and otherwise to provide with respect thereto.
 

Act 561: AN ACT
To amend and reenact Subsections E and F of Section 1586.1 of Title 13 of the Louisiana Revised Statutes of 1950, relative to arrest, fingerprint and other records of juveniles, to provide for the destruction of such records of persons who were adjudicated neglected, in need of supervision or delinquent, provided that in the latter case the adjudication resulted from the commission of minor criminal acts; to exemplify such minor criminal acts; to require that five years must elapse from the final discharge of persons before the files and records of proceedings in which they were involved may be destroyed; to prohibit the destruction of such records of persons adjudicated delinquent as a result of the commission of violent crimes against persons; to specify such crimes, and otherwise to provide with respect thereto.

Act 562: AN ACT
To amend Title 13 of the Louisiana Revised Statutes of 1950 by adding thereto a new section, to be designated as R.S. 13:1583.1 thereof, relative to court ordered examination and treatment of children, to require the Louisiana Health, and Social and Rehabiliation Services Administration through its Division of Charity Hospital of Louisiana in New Orleans to establish a diagnostic psychiatric center for delinquent children at the Charity Hospital of Louisiana at New Orleans and to provide facilities for court ordered examination of such children.

Act 563: AN ACT
To amend Section 1580 of Title 13 of the Louisiana Revised Statutes of 1950 by adding thereto a new paragraph to be designated as
Paragraph (5), relative to decrees of the juvenile courts, to authorize a judge to order a child adjudicated delinquent to attend a state supported school, or vocational-technical school if such school agrees to admit the child; to prohibit the fact of the adjudication of delinquency from being a factor in the school's decision to admit such child, and otherwise to provide with respect thereto.

Act 566: AN ACT
To amend Chapter 6 of Title 13 of the Louisiana Revised Statutes of 1950 by adding thereto new Sections, to be designated as R.S. 13:1600, R.S. 13:1601, R.S. 13:1602, R.S. 13:1603, R.S. 13:1604, and R.S. 13:1605 thereof, relative to juvenile courts, to provide for the judicial termination of parental rights over children and to establish the grounds therefor; to establish a procedure for such termination of parental rights.

Act 568: AN ACT
To amend Title 15 of the Louisiana Revised Statutes of 1950 by adding thereto a new section, to be designated as R.S. 15:1138
thereof, relative to local community centers for juvenile delinquents and children in need of supervision, to require the state to reimburse local communities for the care and maintenance of such children provided that certain standards are met; to establish such standards as to care and maintenance; to authorize the Division of Youth Services to regulate method of reimbursement; to provide the manner in which such payments shall be made; to require local communities to keep records of such payments, and make such reports to the Division of Youth Services as that division may require; to require the said division to adopt the standards of certification as used by the Louisiana Health, and Social and Rehabilitation Services Administration, and otherwise to provide with respect thereto.
