1980 Act No. 428

AN ACT To amend and reenact Paragraph (34) of Section 1 and Sections 61, 64, 69, 71, 72, 74, 75, 76, 402, 407, 452, Subsection C of Section 454, 458, Subsection D of Section 465, and Section 509, all of Title 8 of the Louisiana Revised Statutes of 1950 and to amend Section 302 of said Title 8 by adding thereto a new Subsection, to be designated R.S. 8:302 (D), amend Section 454 of said Title 8 by adding thereto a new Subsection, to be designated R.S. 8:454(D), and to further amend said Title 8 by adding thereto a new Section, to be designated R.S. 8:69.1, all relative to cemeteries and the Louisiana Cemetery Board, to provide with respect to the definition of perpetual or endowed care cemeteries and the requirements therefor; to provide for an administrative director of the board; to provide relative to legal representation of the board and legal proceedings against a cemetery authority; to provide with respect to the request for a hearing following denial of a certificate of authority to operate a cemetery; to require a certificate of authority for certain operations; to authorize the board to have certain access to the courts; to require the filing of certain maps, surveys or plats; to provide with respect to an application for a license; to provide with respect to the sale or transfer of a cemetery organization; to provide with respect to the interment spaces for which deposits must be made to a trust fund; to provide relative to the exemption of the trust fund from seizure; to provide relative to the trustee's duty of care, and otherwise to provide with respect thereto.
