ACT No. 312 To implement the adoption of the Louisiana Code of Criminal Procedure by: (1) Amending and re-enacting Sections 1558 through 1563, 1565, and 1625 of Title 33 of the Louisiana Revised Statutes of 1950, relative to the functions of coroners and matters related thereto; (2) Adopting, enacting, and adding the following new sections to Title 33 of the Louisiana Revised Statutes of 1950: Section 1557.1, providing fees for coroners' experts; Section 1559.2, providing for parish or city laboratories for the use of coroners; Section 1561.1, providing for the delivery of the body or burial arrangements after a coroner completes an autopsy or investigation; Section 1561.2, regulating the cremation of bodies; and Section 1568, requiring notification of death under suspicious circumstances and providing penalties for failure to comply; (3) Repealing Section 1564 of Title 33 and Sections 28, 29, 32, 39, and 40 of Title 15 of the Louisiana Revised Statutes of 1950, which sections are superseded; and (4) Providing the effective date of this Act.

Art. 31. Failure to give peace bond; effect If the defendant fails to give the peace bond required under Articles 29 and 30, he shall be committed to jail. The defendant may be discharged by the committing or some other magistrate upon giving bond as ordered. The committing magistrate may revoke or modify his order for a peace bond.
A defendant who has been committed for failure to give a peace bond ordered by a justice of the peace may not be held longer than five days.

Art. 161. Property subject to seizure A judge may issue a warrant authorizing the search for and seizure of any thing within the territorial jurisdiction of the court which:
(1) Has been the subject of theft;
(2) Is intended for use or has been used as a means of committing an offense; or
(3) May constitute evidence tending to prove the commission of an offense.
A judge may also issue a search warrant in all other cases specifically provided by law. A justice of the peace may issue a search warrant only in those cases specifically provided by law.

Art. 931. Courts, judges, and magistrates Except where the context clearly indicates otherwise, as used in this Code:
(1) "Court" means a court with criminal jurisdiction or its judge. It does not include a mayor's court or a justice of the peace.
(2) "City court" means a city, town, village, or other municipal court, with criminal jurisdiction. It does not include a mayor's court or a justice of the peace.
(3) "Judge" means a judge of a court, as defined in this article.
(4) "Magistrate" means any judge, a justice of the peace, or a mayor of a mayor's court.
